Kyle Pie in the Sky 2023 - Hot Air Balloon Application

In consideration of being permitted to participate in the Kyle Pie in the Sky Hot Air Balloon Festival, I hereby certify that I am aware of and agree with the responsibility legally transferred to me under the Federal Aviation Regulation as regards to my personal decision to fly my hot air balloon, and any bodily injury or property damage resulting therefrom is solely my liability. I agree to the following: 1. Arrive with a CURRENT private or commercial LTA Free Balloon License. This means a current BFR. My balloon will be airworthy with a current "annual." 2. Make Airworthiness Certificate, Registration Certificate, Pilot Certificate, and Aircraft logbooks and Pilot logbooks available at registration. 3. Cooperate fully with event officials with regard to safety regulations, rules, and judgement of officials. The Ballon Operations Chair and Balloonmeister's word is final. 4. Have balloon insurance policy in force with minimum liability limits of $1,000,000 minimum each occurrence combined bodily injury and property damage, including passengers, but not less than $100,000 minimum passenger liability for each and every passenger I carry, through an insurance company with the BEST rating of at least B+ or its equivalent. 5. Have my insurance company provide a Certificate of Insurance stating coverage listed in item 4 above at the time of registration. I will list the Kyle Pie in the Sky Hot Air Balloon Festival and the City of Kyle as additional insured on my policy. 6. Attend all pilot meetings. 7. No student pilots 8. Use a safety restraint during all launches and glows. If tethering, TWO TIE-OFFS will be required. 9. Hold the responsibility legally transferred to me under the FARs as regard to my personal decision to fly my balloon, and any bodily injury or property damage resulting therefore is solely my liability. I further agree that none of the flights are mandatory and I will make all flights at my option. My decisions as a Pilot in Command may affect my placement in this event if I choose not to fly. 10. As the Pilot in Command, I am in full and complete charge and control of my balloon and am responsible for all decisions made concerning same and all things and persons in or connected with my balloon both on the ground and in the air. Officials of this event may supply information, guidance or data, but I understand that I act or rely on such information at my own peril and that the officials assume no responsibility for the completeness or accuracy of such information. 11. I understand that the organizers may inspect all balloons entered in the event; but that such inspection is only for the purpose of determining whether the balloon complies with all rules of eligibility of the Kyle Pie in the Sky Hot Air Balloon Festival. The approval of the balloon by said officials does not constitute a representation or warranty of any kind of character whatsoever concerning the mechanical condition of the aircraft, or whether or not it is airworthy. 12. Give permission, without any restriction, to Kyle Pie in the Sky Hot Air Balloon Festival to use still photograph, motion pictures and sound recordings of me, my balloon, equipment, chase crew members, employees, and agents for any news, advertising, or promotional media and commercial uses. I understand this agreement, the event rules, registration, and entry form contain all the terms and conditions agreed to by the parties hereto, and no other agreements, discussion, oral or written, regarding the subject matter of the Agreement shall be deemed to exist or bind any parties hereto. I agree that the organizers and sponsors of this event are providing me with the facilities and means for my participation in this event and in no way do they supersede the responsibility of the Pilot in Command as shown in the Federal Aviation Regulations or otherwise. Thus, I release the City of Kyle, Kyle Pie in the Sky Hot Air Balloon Festival, their Officers, Directors, Employees, Agents, Recipient Charity, and Sponsors from liability for their actions in conducting the Kyle Pie in the Sky Hot Air Balloon Festival. I hereby declare that I am participating in the Kyle Pie in the Sky Hot Air Balloon Festival of my own free will and that I accept the Rules and Regulations and any changes and/or additions. *The entry fee for sport balloons is $50.00. An invoice will be sent out for payment once application is accepted. *The entry fee for Corporate Sponsored Hot Air Balloons is $500.00. An invoice will be sent out for payment once application is accepted.
